Billing Terms and Conditions

These Billing Terms and Conditions (“Terms”) govern all purchases, subscriptions, and services provided by 18 Street Design, LLC (“Company,” “we,” “us,” or “our”), including one-time payments and recurring maintenance subscriptions processed through Stripe.

By making a purchase or starting a subscription, you agree to these Terms.

1. Services

We provide web design, website maintenance, design services, web development, maintenance plans.

Offerings may include:

  • One-time purchases
  • Subscription-based services or maintenance plans
  • Digital products and/or ongoing services

All descriptions, pricing, and availability are subject to change at any time.

2. Payments

All payments are processed securely through Stripe, a third-party payment processor.

We do not store or have access to your full payment card details. By submitting payment information, you authorize us to charge the applicable amount, including taxes and fees, to your selected payment method.

3. One-Time Purchases

For one-time payments:

  • Charges are billed once at checkout
  • Delivery of digital services is considered complete once access is provided or service begins
  • All sales are final unless otherwise stated in writing

4. Subscriptions and Maintenance Plans

Subscriptions and maintenance plans provide recurring access or services billed on a monthly, annual, or other recurring basis as disclosed in your contract.

By subscribing, you authorize automatic recurring charges until cancellation.

Subscriptions automatically renew at the end of each billing period unless canceled before renewal.

5. Pricing and Taxes

Prices are listed in US dollars unless otherwise stated.

You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

6. Pricing Changes

We may modify pricing at any time.

For subscriptions, pricing changes take effect at the next renewal period. Continued use after renewal constitutes acceptance of the new price.

7. Maintenance Plan Cancellations

Monthly maintenance plan subscriptions may be canceled at any time after an initial three month commitment via the Stripe dashboard or by contacting us. Maintenance plans paid annually may be canceled at any time, but the subscription will run for the remainder of the contracted term and will not renew and no refunds will be provided for any remaining term.

Cancellation:

  • Stops future billing for maintenance plans paid monthly
  • Does not refund charges already paid
  • Maintains service through the end of the current billing period/term

8. Refund Policy

Unless otherwise stated in writing:

  • One-time purchases are non-refundable
  • Subscription fees are non-refundable, including:
    • Partial billing periods
    • Unused time
    • Failure to cancel before renewal
    • Account inactivity or client failure to request updates
  • Refunds, if approved, are issued to the original payment method via Stripe.

9. Failed Payments

If a payment fails:

  • We may retry charges automatically
  • Access may be suspended until payment succeeds
  • Continued failure may result in cancellation and demand for payment
  • You are responsible for maintaining valid payment information.

10. Chargebacks and Disputes

You agree to contact us before initiating a chargeback or payment dispute.

Fraudulent or excessive chargebacks may result in:

  • Immediate termination of services
  • Permanent suspension of services

We reserve the right to submit evidence of these Terms to Stripe or your card issuer.

11. Prohibited Use

You may not:

  • Use our services for unlawful purposes
  • Resell or exploit services without permission
  • Interfere with service security or operations
  • Violations may result in immediate termination without refund.

12. Service Availability

  • We strive for reliable service but do not guarantee uninterrupted availability.
  • Temporary outages, maintenance, or third-party failures do not entitle you to refunds or credits.

12. No Warranties

  • All services are provided “as is” and “as available.”
  • We disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted access.

13. Limitation of Liability

To the maximum extent permitted by law, 18 Street Design, LLC shall not be liable for indirect, incidental, or consequential damages.

Our total liability shall not exceed the amount paid by you to us during the 3 (three) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless 18 Street Design, LLC from claims arising from your use of our services or violation of these Terms.

15. Third-Party Services

Our services may rely on third-party platforms, including Stripe. We are not responsible for outages or policy changes caused by third parties.

16. Governing Law

These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law principles.

All disputes shall be resolved exclusively in courts located in Lexington County, South Carolina.

17. Changes to These Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance.
